Terms of Use

1. Agreement

By downloading, accessing, or using LAYR, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. "LAYR," "we," "us," and "our" refer to Brue as operator of LAYR.

2. Eligibility

You must be at least 13 and legally able to agree to these Terms. If the law where you live requires a higher age, or if you are not old enough to enter a contract, a parent or legal guardian must review and accept these Terms for you. You may not use LAYR where its use is prohibited by law.

3. Accounts

Keep your account details accurate and your device and credentials secure. You are responsible for activity under your account. Tell us promptly at hey@brue.cc if you suspect unauthorized use. Do not impersonate another person, share access in a way that undermines account security, or create accounts to evade a restriction.

4. Limited license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use LAYR for lawful personal purposes, subject to these Terms and the Apple App Store rules. LAYR and its software, design, branding, and service content remain owned by Brue or its licensors.

5. Acceptable use

You must not:

• Upload content you do not have the right or permission to use.
• Use LAYR to violate privacy, publicity, intellectual-property, or other rights.
• Submit illegal, abusive, exploitative, hateful, or sexually explicit content.
• Probe, disrupt, overload, reverse engineer, or bypass service or credit controls, except where law expressly permits.
• Use automation to scrape LAYR, resell access, or create competing datasets or models.
• Misrepresent AI output as professional, verified, or created by another person.

We may block content or suspend activity that appears unsafe, unlawful, abusive, or inconsistent with these Terms.

6. Your content

You retain your rights in the images, preferences, and other content you submit. You give LAYR a worldwide, non-exclusive license to host, copy, transform, analyze, display, and transmit that content only as needed to operate, secure, support, and improve the service. This license ends when the content is deleted, except for limited backup, security, legal, or de-identified records described in the Privacy Policy.

You represent that you have the rights needed to submit your content and allow this processing. You are responsible for checking imported product facts and AI results before relying on them.

7. AI features and limitations

LAYR uses automated systems to label garments, separate items, generate outfit ideas, and improve images or metadata. AI output may be inaccurate, incomplete, repetitive, unsuitable, or unexpectedly similar to other output. It is not professional medical, safety, legal, financial, cultural, or dress-code advice.

Check fit, weather, workplace or event rules, garment care, accessibility, and personal safety yourself. Do not rely on LAYR where an error could cause harm. We may reject a request or output for quality, rights, safety, or provider-policy reasons.

8. Subscriptions, billing, and restore

LAYR may offer Monthly and Yearly auto-renewing subscriptions. The price, included features, trial if any, and billing period shown on the Apple purchase screen at confirmation control your purchase. Prices and availability may vary by country and may change as permitted by Apple and applicable law.

Subscriptions automatically renew unless you cancel them through your Apple Account settings before the renewal deadline Apple displays. Apple processes payment and renewal. Deleting LAYR or your LAYR account does not cancel an Apple subscription. You may keep access until the end of the paid period, subject to Apple rules and any refund or billing correction.

Use the restore purchases control to restore an eligible subscription associated with the same Apple Account. Restore does not create a second purchase or an extra credit grant. If access does not update, contact us with non-sensitive purchase details; never email a password or full payment-card number.

9. AI Credits

AI Credits are limited service units, not money, property, cryptocurrency, or a stored-value balance. They cannot be transferred, sold, redeemed for cash, or used outside LAYR. Your subscription may grant credits on the cadence shown in the app. A Yearly subscription may release its included credits in monthly slices rather than all at once.

One successful, durable user-requested premium action uses one AI Credit, regardless of internal provider calls or automatic retries. A failed request, moderation rejection, fidelity rejection, or persistence failure uses none. We may correct a balance affected by duplicate events, refunds, fraud, abuse, or a technical error. Unused credits expire according to the grant period shown in the app and do not survive a valid refund or charge reversal where the related grant is revoked.

10. Refunds

Apple handles App Store billing and Refunds. Eligibility is decided by Apple under its policies and applicable law. Request a refund through reportaproblem.apple.com. If Apple refunds or reverses a purchase, related access and unused AI Credits may be removed or adjusted. Nothing in these Terms limits non-waivable consumer rights.

11. Third-party services

LAYR depends on Apple, RevenueCat, Cloudflare, AI providers, analytics, and any connected source you choose. Their terms and privacy policies govern their own services. We are not responsible for third-party products, websites, outages, or changes outside our reasonable control.

12. Service changes

LAYR is evolving. We may add, change, limit, suspend, or discontinue features, providers, plans, or availability. We will provide notice where required and will not take away non-waivable rights. Preview and beta features may be less reliable and may change without notice.

13. Termination

You may stop using LAYR and request account deletion at any time; remember to cancel an active Apple subscription separately. We may restrict or terminate access if you materially or repeatedly violate these Terms, create security or legal risk, misuse AI Credits, or fail to pay, subject to notice and applicable law. Provisions that by nature should survive termination will survive.

14. Disclaimers

To the fullest extent permitted by law, LAYR is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not guarantee that an outfit, label, color analysis, image, or suggestion will be accurate, flattering, appropriate, available, or free of errors.

15. Limitation of liability

To the fullest extent permitted by law, Brue and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from LAYR. Our aggregate liability for a claim will not exceed the greater of the amount you paid for LAYR in the 12 months before the claim or US$50. These limits do not apply where prohibited or to liability that cannot legally be limited.

16. General terms

If part of these Terms is unenforceable, the remaining terms stay in effect. A delay in enforcement is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, sale, or transfer of LAYR, subject to law. These Terms and the Privacy Policy form the agreement between you and Brue about LAYR, except for rights supplied by Apple or mandatory local law.

We may update these Terms for service, security, provider, or legal changes. We will post the revised date and give additional notice when required. Continued use after an update takes effect means you accept it where permitted by law.
